H.R. 2749 contains language that will make Food Defense Plans mandatory for FDA inspected facilities.
The term `facility' means any factory, warehouse, or establishment (including a factory, warehouse, or establishment of an importer) that manufactures, processes, packs, or holds food.

This directive continues to provide IPP with new frequencies for verifying a risk-based approach to Food Defense Verification Procedures.
In the Constituent Update from FSIS dated May 23, 2008, the following is an excerpt from that information:
“The Agency is expecting to see a goal of a 50% adoption rate since the prior two surveys in which the adoption rate was less than 50%. Ultimately, FSIS is expecting industry to reach a goal of at least 90% of plants adopting functional food defense plans in order to stave off the agency’s move forward with rulemaking that will mandate functional food defense plans.”
FSIS conducted a survey of plants having functional Food Defense Plans in August 2008. The results of that survey are:
Large Plants are at 89% (310/348)
Small Plants are at 58% (1199/2085)
Very Small Plants are at 21% (545/2630)
Resulting in an overall total of 41% which is +14% change, but not the 98% goal set by FSIS.
